TERMS & CONDITIONS

By purchasing or using the Lead Recovery & Booking System ("Service") provided by EchoLabs Marketing ("Company," "we," "us," or "our"), you ("Client") agree to the following Terms & Conditions.

1. SERVICES
EchoLabs Marketing will provide the Lead Recovery & Booking System, which includes:

• Missed call text-back automation setup
• Lead recovery workflow configuration
• Appointment booking system integration
• Ongoing system maintenance and performance monitoring
• Monthly reporting

Service scope and deliverables will be as described at the time of purchase. Any additional services outside the defined scope will require a separate agreement and may be subject to additional fees.

2. FEES & PAYMENT

2.1 Setup Fee
A one-time, non-refundable setup fee of $500.00 USD is due upon signing. This fee covers system configuration, workflow build-out, and launch of your Lead Recovery & Booking System.

2.2 Monthly Maintenance & Reporting Fee
A recurring monthly fee of $149.00 USD will be billed on the same date each month, beginning after setup is complete. This fee covers ongoing system maintenance, performance monitoring, and monthly reporting.

2.3 Payment Terms
All invoices are due upon receipt. Failure to pay within 7 days of the due date may result in suspension of services. Accounts more than 30 days past due may be subject to late fees and/or termination.

2.4 Payment Methods
We accept major credit/debit cards and other payment methods as listed on your invoice. All payments are processed securely.

3. CANCELLATION POLICY

3.1 Client Cancellation
Either party may cancel the monthly service with 30 days written notice. The one-time setup fee is non-refundable under any circumstances.

3.2 Cancellation by EchoLabs Marketing
We reserve the right to terminate services immediately if the Client violates these Terms & Conditions, engages in prohibited activities, or fails to make payment.

3.3 Upon Cancellation
Upon cancellation, the Client's automated systems will be deactivated. EchoLabs Marketing is not responsible for any lost leads, revenue, or data after service termination.

4. REFUND POLICY
The one-time $500.00 setup fee is strictly non-refundable. Monthly fees are non-refundable for the current billing period at the time of cancellation. No partial refunds will be issued for unused days within a billing cycle.

5. CLIENT RESPONSIBILITIES
The Client agrees to:

• Provide accurate business information required for system setup
• Maintain a valid payment method on file
• Comply with all applicable SMS/telecommunications regulations (TCPA, CAN-SPAM)
• Obtain proper consent from their contacts before sending messages
• Notify EchoLabs Marketing promptly of any changes to their business information or requirements

EchoLabs Marketing is not responsible for regulatory violations resulting from the Client's failure to obtain proper consent from their contacts.

6. LIMITATION OF LIABILITY
EchoLabs Marketing's liability is limited to the total fees paid by the Client in the 30 days prior to the claim. We are not liable for:

• Lost revenue, leads, or business opportunities
• Third-party platform outages (e.g., SMS carriers, CRM platforms)
• Indirect, incidental, or consequential damages of any kind

7. INTELLECTUAL PROPERTY
All systems, workflows, templates, and processes created by EchoLabs Marketing remain the intellectual property of EchoLabs Marketing. The Client is granted a limited, non-transferable license to use the system for the duration of the service agreement.

8. CONFIDENTIALITY
Both parties agree to keep confidential any proprietary business information shared during the course of this agreement and not to disclose it to third parties without prior written consent.

9. RESULTS DISCLAIMER
EchoLabs Marketing does not guarantee specific results, lead volumes, or booking rates. Performance depends on factors including but not limited to the Client's industry, call volume, and market conditions.

10. GOVERNING LAW
These Terms & Conditions shall be governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Florida.

11. MODIFICATIONS
EchoLabs Marketing reserves the right to modify these Terms & Conditions at any time. Clients will be notified of material changes with at least 14 days notice. Continued use of the Service after notice constitutes acceptance of the updated terms.

12. ENTIRE AGREEMENT
These Terms & Conditions, together with your invoice, constitute the entire agreement between EchoLabs Marketing and the Client regarding the Lead Recovery & Booking System service.
